Privacy Policy

This policy explains what we collect when you use our website or book a charter, why we collect it, who we share it with, and what control you have.

Last updated: August 22, 2026

Information collected automatically:

  • IP address, browser type, device type, operating system, and general location (city/region level)
  • Pages viewed, links clicked, time on site, and the site you came from
  • Cookies and similar technologies (see Section 7)

We do not collect your full payment card number. Card details go directly to our payment processor. We receive only a confirmation, the last four digits, and the card brand.

We do not knowingly collect information from children under 13. Our site is intended for adults booking charters. If you believe a child has given us information, contact us and we will delete it.

3. Why We Use It

We use your information to:

  • take, confirm, and run your booking, and to contact you about it;
  • process payments and prevent fraud and chargebacks;
  • reach you about weather, delays, meeting instructions, or safety matters before your charter;
  • keep guest count within legal passenger limits and accommodate stated safety or medical needs;
  • respond to inquiries and provide customer service;
  • maintain records required for tax, insurance, and legal purposes;
  • improve the website and understand which pages and vessels people are interested in;
  • send marketing messages, but only where you have given us the consent described in Section 5.

We do not use your information to make automated decisions that produce legal or similarly significant effects about you.

4. Who We Share It With

We share your information only with service providers who need it to help us operate, and only for that purpose:

  • Payment processor — to charge your card and handle refunds and disputes
  • Website hosting and backend provider — to run the site and store booking data
  • Email delivery service — to send booking confirmations and, if you've opted in, marketing
  • Analytics provider — to understand site usage
  • Add-on vendors you book through us — caterers, photographers, and similar, receiving only what they need for your charter
  • Our insurer, accountant, or attorney — where reasonably necessary
  • Law enforcement, the U.S. Coast Guard, or other authorities — where required by law, subpoena, or in an emergency involving safety of life

We do not sell your personal information. We do not share it with data brokers. We do not let anyone use our customer list for their own marketing.

If our business is sold or merged, customer information may transfer as part of that transaction. You'll be notified if that materially changes how your information is handled.

5. Marketing Emails and Text Messages

This is important, and Florida has strict rules about it.

We send booking-related messages — confirmations, reminders, weather updates, meeting instructions — to every customer. These are necessary to deliver the service you purchased and are not marketing.

We send marketing emails and texts only if you have separately and affirmatively opted in, by checking a box or otherwise clearly agreeing. Booking a charter alone does not opt you into marketing.

Text messages. By opting into marketing texts, you consent to receive automated promotional messages at the number you provide. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time, or HELP for help. We honor STOP requests promptly and in any event within 15 days.

We do not send marketing calls or texts outside 8:00 a.m. to 8:00 p.m. in your local time.

Email. Every marketing email has an unsubscribe link. You can also email us at quericocharters@gmail.com and we'll remove you.

We maintain records of marketing consent as required by the Florida Telephone Solicitation Act (Section 501.059, Florida Statutes) and the federal Telephone Consumer Protection Act.

6. How Long We Keep It

  • Booking and payment records: 7 years, for tax, insurance, and legal reasons.
  • Inquiries that never became bookings: 24 months.
  • Marketing list: until you unsubscribe, then we keep a suppression record so we don't contact you again.
  • Website analytics: 26 months.
  • Safety or incident records: 7 years or longer where an insurance claim or legal matter is open.

7. Cookies and Tracking

We use:

  • Essential cookies — required for the site, your cart, your booking session, and security. These can't be turned off without breaking the site.
  • Analytics cookies — to see how people use the site so we can improve it.

You can block or delete cookies in your browser settings; essential cookies being blocked may prevent booking. If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of any sharing for targeted advertising.

8. Security

We use industry-standard measures to protect your information, including encryption in transit (HTTPS), access controls limiting who on our team can see booking data, and a payment processor that handles card data under PCI DSS.

No system is perfectly secure. We can't guarantee that a determined attacker will never get in. If a breach affects your personal information, we will notify you as required by Florida's data breach law (Section 501.171, Florida Statutes).

9. Your Choices and Rights

Regardless of where you live, you can:

  • Ask what we have about you
  • Correct anything inaccurate
  • Ask us to delete your information, subject to records we must keep for tax, insurance, safety, or legal reasons
  • Opt out of marketing at any time
  • Close your account

Email quericocharters@gmail.com and we'll respond within 30 days. We may need to verify your identity before acting on a request — usually by confirming details of a booking.

A note on Florida law. The Florida Digital Bill of Rights imposes its main obligations on very large companies — generally those with over $1 billion in global annual revenue. QueRico is well below that threshold, so those obligations do not apply to us. We offer the rights above as a matter of practice, not because we are required to.

Visitors from California, Colorado, Virginia, and similar states. If a state privacy law applies to your information, we will honor the rights it gives you. We do not sell personal information or share it for cross-context behavioral advertising as those terms are defined in those laws.

Visitors from the EU or UK. If you book with us from the EU or UK, our legal bases for processing are: performance of a contract (your booking), legitimate interests (running and improving our business, and security), consent (marketing and non-essential cookies), and legal obligation (tax and safety records). Your information will be processed in the United States, which does not have an equivalent data protection regime. You have the right to lodge a complaint with your local supervisory authority.

10. Third-Party Links

Our site links to third parties, including our payment processor, mapping services, marinas, and social media. This policy does not cover them. Read their policies before giving them information.

11. Photography Aboard

We may photograph or record charters for marketing purposes. Details, and how to opt out, are in Section 15 of our Terms of Service. Tell the Captain before departure if you don't want to appear in our content.

12. Changes to This Policy

We may update this policy. The "Last updated" date above will change, and material changes will be posted prominently on this page. Continuing to use the site after an update means you accept the revised policy.
