Charter Terms

Please read these Terms carefully. They contain important limits on our liability, deadlines for bringing a claim, and rules about your charter.

Last updated: August 22, 2026

By booking a charter, using this website, or boarding one of our vessels, you agree to these Terms.

1. Who We Are

QueRico Yacht Charters ("QueRico," "we," "us," "our") is a crewed yacht charter business operating in Miami-Dade County, Florida. Our mailing address is Miami, FL and you can reach us at (786) 714-7023 or quericocharters@gmail.com.

"You," "Charterer," or "Guest" means the person who books a charter and every person who boards a vessel under that booking. The person who books is responsible for making sure everyone in their party has read and follows these Terms.

2. What You Are Booking

You are booking a crewed charter. That means we provide the vessel, a licensed captain, and crew. You are not renting a boat to operate yourself.

This is not a bareboat charter, and QueRico is not a "livery" as that term is defined in Section 327.54, Florida Statutes, because we furnish the captain and crew and retain control of the vessel at all times.

The Captain has full and final authority over the vessel, the route, the itinerary, and everyone aboard. Requests are welcome; the Captain's decision is final.

3. Passenger Capacity

Every vessel has a maximum passenger count set by federal law and by that vessel's certification. We cannot exceed it under any circumstances, for any reason, for any amount of money. This is a U.S. Coast Guard requirement, not a preference.

The maximum guest count for each vessel is listed on that vessel's page.

Every person counts, including infants, children, and anyone who boards for only part of the charter.

If your party arrives with more people than your booking allows, the extra guests will not be permitted to board. If that means the charter cannot proceed, it is treated as a no-show under Section 7 and no refund is given.

Booking for fewer guests than will actually attend is a material breach of these Terms.

4. Booking, Pricing, and Payment

Prices are shown per hour, per vessel, with a minimum charter length noted on each vessel's page.

No payment is collected on this website. Pricing is confirmed directly with QueRico, and payment is arranged with us separately.

A request submitted on this site does not reserve a date. Your booking is confirmed only once QueRico confirms it with you directly.

We may place a temporary authorization hold on your card for potential damage or excess cleaning under Section 14.

All prices are in U.S. dollars. Payments are processed by our third-party payment processor; we do not store your full card number.

Rates, availability, and add-ons shown on this website are subject to change and to confirmation. If an obvious pricing error occurs, we will contact you and you may cancel for a full refund rather than pay the corrected price.

Gratuity for the crew is not included and is not automatic. It is customary in Miami to tip the crew 15–20% of the charter fee if you enjoyed your day.

5. Arrival, Departure, and Charter Time

Your charter time begins at your scheduled departure time, not when you board.

Please arrive at the marina at least 15–30 minutes before departure. Marina parking and boarding take longer than people expect.

If you are late, the lost time comes out of your charter. We cannot extend the end time, because another party is usually booked behind you.

If you are more than 30 minutes late without contacting us, the Captain may treat the charter as a no-show under Section 7.

Extending your charter on the day of is possible only if the vessel and crew are available. Additional time is billed at the vessel's hourly rate, payable that day.

6. Weather, Safety, and Captain's Authority

Boating depends on conditions. Miami weather changes fast, and hurricane season runs June through November.

The Captain may cancel, shorten, delay, or change the route of any charter at any time for safety reasons. This includes weather, sea state, small craft advisories, mechanical issues, guest behavior, or medical concerns.

If we cancel before departure for weather or safety, you may choose: (a) reschedule at no charge, subject to availability, or (b) a full refund of amounts paid.

If the Captain ends a charter early for weather or safety after departure, you will receive a prorated credit for the unused time.

Rain alone is not a cancellation. Charters run in light rain. Cancellation decisions are based on wind, sea state, and lightning, and are made by the Captain.

If you cancel because you don't like the forecast, standard cancellation terms in Section 7 apply.

7. Cancellations, Reschedules, and Refunds

Cancellation by you:

When you cancelWhat happens
More than 7 days before departureFull refund of amounts paid
3–7 days before departure50% refund, or full credit toward a future charter within 12 months
Less than 72 hours before departureNo refund
No-show, or arrival too late to departNo refund

Reschedules. You may reschedule once at no charge if you request it more than 7 days before departure, subject to availability. Later reschedule requests are treated as cancellations.

Refund method. Refunds are issued to the original payment method and typically post within 5–10 business days, depending on your bank.

Third-party costs. Add-ons already purchased on your behalf from third parties (catering, photography, decor) may be non-refundable regardless of when you cancel. We will tell you if that applies.

8. Assumption of Risk

Boating involves risks that cannot be eliminated. By boarding, you acknowledge and voluntarily accept the ordinary and inherent risks of being on the water, including:

  • vessel motion, wakes, waves, sudden movement, and slippery or wet surfaces;
  • slips, trips, and falls on deck, on ladders, on the swim platform, and while boarding or disembarking;
  • sun exposure, dehydration, heat, seasickness, and wind;
  • swimming, snorkeling, paddleboarding, tubing, water toys, and any other in-water activity, including drowning, marine life, currents, and boat traffic;
  • weather changes, mechanical issues, and the conduct of other vessels and other people aboard.

You are responsible for knowing your own physical condition and limits, and for telling the Captain before departure about any medical condition, mobility limitation, pregnancy, allergy, or non-swimmer in your party that could matter in an emergency.

Swimming is at your own risk. We are not lifeguards. Children must be supervised by an adult in their party at all times, in and out of the water.

9. Life Jackets and Safety Equipment

Every vessel carries U.S. Coast Guard–approved life jackets for every person aboard, plus required safety equipment.

Florida law requires every child under 6 years old to wear an approved life jacket at all times while a vessel under 26 feet is underway (Section 327.50, Florida Statutes). We enforce this without exception.

The Captain may require any guest to wear a life jacket at any time.

You must listen to the safety briefing before departure and follow all crew instructions.

10. Alcohol, Smoking, and Drugs

Alcohol. QueRico does not sell, serve, or supply alcoholic beverages. Guests 21 and over may bring their own alcohol aboard. Anyone who appears to be under 30 should expect to be asked for government-issued ID. Guests under 21 may not possess or consume alcohol aboard, and adults in the party are responsible for enforcing this.

The Captain and crew do not drink while working. Florida law prohibits operating a vessel while impaired (Section 327.35, Florida Statutes).

The Captain may refuse boarding to, or end the charter for, any guest who is visibly intoxicated or whose behavior creates a safety risk. If a charter is ended for this reason, no refund is given.

Illegal drugs are strictly prohibited aboard any QueRico vessel. Possession will end the charter immediately with no refund and may be reported to law enforcement.

Smoking and vaping are permitted only in designated exterior areas at the Captain's direction. Cigarettes must never be thrown overboard.

Glass is permitted aboard. No red wine or dark liquid on white upholstery — spills are billed under Section 14.

11. Rules Aboard

  • No shoes with dark or hard soles on deck. Bring bare feet or soft, non-marking soles.
  • No fishing unless arranged in advance.
  • No pets unless arranged in advance and confirmed in writing.
  • No jumping or diving from the vessel except where and when the Captain permits.
  • Nothing may be thrown overboard. Discharging trash into Florida waters is illegal.
  • Follow all crew instructions immediately, especially during docking, anchoring, and swimming.

The Captain may end any charter early, and return to the dock, for violation of these rules, unsafe or abusive behavior toward crew or other guests, or damage to the vessel. No refund is given for a charter ended for these reasons.

12. Children and Minors

Guests under 18 must be accompanied by a parent or legal guardian, who is responsible for their supervision, behavior, and safety at all times. The booking party warrants that it has authority to agree to these Terms on behalf of any minor in the party.

13. Itineraries and Destinations

Destinations, sandbars, and points of interest shown on this website are examples, not guarantees. Actual routes depend on weather, tide, sea state, traffic, and the Captain's judgment. Sandbar conditions in particular depend on tides and can change day to day.

International trips, including to Bimini or elsewhere in The Bahamas, require valid passports for every guest, advance arrangement, customs clearance, and additional fees. They are not available on standard charters.

14. Damage, Cleaning, and Loss

You are responsible for damage to the vessel, its equipment, or its furnishings caused by you or anyone in your party, beyond ordinary wear.

Excessive cleaning beyond normal post-charter cleaning — including vomit, spilled food or drink on upholstery, glitter, confetti, or similar — is billed at $250 to $500, depending on severity.

Actual repair or replacement cost is billed for damaged or lost equipment.

We may charge the card on file for these amounts and will send you an itemized explanation.

Personal property is your responsibility. We are not responsible for loss, theft, or damage to phones, sunglasses, jewelry, keys, clothing, or anything else you bring aboard. Do not bring valuables you cannot afford to drop in the ocean.

15. Photography and Media

We may photograph or record charters for marketing purposes. By boarding, you consent to the use of your likeness in QueRico's marketing materials, website, and social media without compensation. If you do not want to appear in our content, tell the Captain before departure and we will accommodate you.

You may take your own photos and video. Please don't post content that identifies our crew members by name without their permission.

16. Third-Party Services

Catering, photography, DJs, decor, water toys, and similar add-ons may be provided by independent third parties. We arrange them as a convenience. We are not responsible for the acts, omissions, quality, or timeliness of third-party providers, and your remedy for a problem with a third-party service is against that provider.

17. Limitation of Liability

Please read this section carefully.

To the fullest extent permitted by applicable law:

  • (a) QueRico is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost enjoyment, lost time, missed connections, or costs of substitute arrangements.
  • (b) Except as stated in subsection (d) below, QueRico's total aggregate liability arising out of or relating to any charter or these Terms shall not exceed the total amount you actually paid to QueRico for the charter giving rise to the claim.
  • (c) QueRico is not liable for any loss or delay caused by weather, sea state, acts of God, government or Coast Guard action, marina closure, mechanical failure, labor disruption, medical emergency, the acts of other vessels or third parties, or any other cause beyond our reasonable control.
  • (d) Nothing in these Terms limits, and QueRico does not attempt to limit, any liability that cannot lawfully be limited. This includes, without limitation, liability for personal injury or death caused by our negligence or fault where such a limitation is prohibited by 46 U.S.C. § 30527, or any limitation on your right to a trial by a court of competent jurisdiction. Any provision of these Terms that would be void under that statute or under any other applicable law is severed and given no effect, and the remainder of these Terms continues in full force.
  • (e) Nothing in these Terms waives or limits QueRico's rights under the Limitation of Liability Act, 46 U.S.C. § 30501 et seq., or any other protection available to vessel owners under general maritime law.

18. Notice of Claim and Time to Sue

If you have a claim against QueRico arising out of a charter:

  • You must give us written notice of the claim within six (6) months of the date of the incident.
  • You must file suit within one (1) year of the date of the incident.

These periods are the minimums permitted by 46 U.S.C. § 30526 and are shorter than Florida's general limitations periods. They do not apply where the law does not permit them, including the tolling provisions that apply to claims involving minors, incompetent persons, and wrongful death. Failure to give notice is not a bar to recovery in the circumstances described in that statute.

19. Insurance

QueRico maintains vessel liability insurance. This does not insure you. We strongly recommend travel insurance for trip cancellation, and your own health insurance for medical costs, particularly if you are visiting from outside the United States.

20. Website Terms

  • Content. All text, photography, video, graphics, logos, and design on this website are owned by QueRico or licensed to us and may not be copied, scraped, or reused without written permission.
  • Accuracy. We work to keep vessel specifications, pricing, and availability accurate, but we do not warrant that everything on this site is error-free or current. Availability is confirmed at booking.
  • Accounts. If you create an account, you are responsible for its security and for everything done under it. Give us accurate information and keep it current.
  • Acceptable use. Do not use this site to violate any law, interfere with its operation, attempt unauthorized access, scrape data at scale, or make fraudulent or speculative bookings.
  • Availability. The site is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation.
  • Accessibility. We are working to make this site usable by everyone. If you have trouble accessing anything here, contact us at quericocharters@gmail.com and we will help you book by phone.

21. Chargebacks

If you dispute a charge with your bank after receiving the service described in these Terms, you agree we may present these Terms, your booking confirmation, and your acceptance of them as evidence. Fraudulent chargebacks may be referred for collection.

22. Governing Law and Venue

These Terms and any charter are governed by the general maritime law of the United States and, where general maritime law does not apply, by the laws of the State of Florida, without regard to conflict-of-law principles.

Any action must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts. Nothing in this Section limits your right to a trial by a court of competent jurisdiction for any claim for personal injury or death.

23. Changes to These Terms

We may update these Terms. The version posted on this website at the time you book is the version that applies to your charter. Material changes will be reflected in the "Last updated" date above.

24. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, that provision is modified to the minimum extent necessary or severed, and the rest remains in force. These Terms, together with your booking confirmation, are the entire agreement between you and QueRico regarding your charter and supersede any prior discussions.
